Artist Agreement
1. What This Agreement Covers
This is the agreement between you and Soul Portrait (yoursoulportrait.art) covering commissions arranged through our platform. It applies from your first confirmed commission onward, and its confidentiality and non-circumvention terms continue to apply after any individual commission is complete.
2. Eligibility & Your Status
You must be at least 18 years old and legally able to enter into this agreement. You work with Soul Portrait as an independent artist, not as an employee or agent of Soul Portrait. You're responsible for your own taxes, business registration, and any local requirements around selling your work internationally.
3. How Matching Works
When a collector completes our questionnaire, we generate an anonymous profile (no name, no contact details, no raw answers) and share it with a small pool of artists we think it might resonate with. If you feel genuinely inspired by a profile, you let us know you're interested, along with the piece you have in mind (size and technique) and the price you'd like to receive. If this is our first commission together, we'll also ask for a short portfolio or reference work we can share with the collector.
We give priority to whoever responds first. Sometimes you'll be the only artist shown to a collector; sometimes we'll show two or three, when we think the collector could use options. Expressing interest doesn't guarantee you'll be the artist selected, another artist may simply have responded first, or the collector may choose differently.
If no artist responds to a profile right away, it simply stays open, there's no deadline forcing us to close it out. If a collector decides not to proceed with an introduction, that's their decision to make and the introduction ends there.
4. Size & Pricing
We work with three standard size tiers, so pricing and shipping stay predictable for everyone:
- S: approximately 60 × 80cm (24 × 32in)
- M: approximately 90 × 120cm (36 × 48in)
- L: approximately 120 × 150cm (48 × 60in) and up
These are targets, not exact cuts, we allow roughly ±10% either way since your work is hand-made. When you express interest in a profile, you tell us which tier fits (or propose a custom size, if a profile genuinely calls for something unusual) and the price you'd like to receive for it. That price is yours: we add our own service fee separately when we charge the collector, and shipping is billed to the collector on top of that, so the number you give us is the number you're paid.
5. Commitment & Escrow
Once you're matched with a collector, they have 7 days to decide whether to proceed. If they do, they place the full amount, your price, our fee, and shipping, into escrow before you begin any work. We confirm the commission to you as soon as those funds are secured. That's your signal to start.
6. Timeline
There's no formal deadline, but we ask for a moral commitment to finish within about four weeks of starting. If you need longer, that's genuinely fine, just tell us early so we can manage the collector's expectations. If we pass roughly eight weeks beyond your own stated target with no meaningful update from you, we'll treat the commission as abandoned (see §13).
7. Staying in Touch During the Commission
We keep collectors anonymous throughout. Any questions between you and them are relayed by us directly, paraphrased rather than forwarded, so their contact details are never exposed to you. Your name, on the other hand, is shared with the collector. Occasionally that means a collector tries to reach you directly, sometimes just to confirm you're real, sometimes for reassurance. If that happens, it isn't a problem, you're welcome to reply, just point anything about the commission itself back to us, since going through us is part of what we promise collectors. Let us know if it happens so we're aware.
8. The “Making Of”
If you'd like to capture photos, notes, or short video while you work, we love including that with the final delivery, it's a genuinely appreciated touch. It's entirely optional, and whatever you do or don't share follows the same rule as the piece itself: nothing goes to the collector until the very end.
9. Changes Once Work Has Started
If you realize partway through that the piece needs to be a different size or use a different technique than what you originally described, tell us before you commit to it. We'll check with the collector and adjust the price if needed, rather than surprising anyone at delivery.
10. Shipping & Delivery
We handle shipping once your piece is complete, including international customs and duties, so the collector never receives a surprise bill alongside their surprise piece. In keeping with the reveal being part of the experience, nothing about the finished work, not a photo, not a description, goes to the collector before it physically arrives. Shipping is insured; if a piece is lost or damaged in transit, we'll work with you on a reship or a remake, or refund the collector if neither is possible. That outcome doesn't reflect on you.
11. Certificate of Authenticity
Every piece ships with a signed certificate of authenticity confirming it was made specifically for that collector and that it's unique.
12. When You Get Paid
We release your payment once delivery is confirmed. If a collector goes unresponsive right at the finish line, your payment won't get stuck waiting on them, after three documented delivery attempts over four weeks, we release your funds regardless. You've done your part.
13. If a Commission Falls Through
If a commission is abandoned, whether you're unable to finish or go quiet past the timeline in §6, the collector receives a full refund and you forfeit payment for that piece. The exception is the kill fee below, which covers work stopped for reasons genuinely outside your control.
14. Kill Fee
If a commission has to stop partway through for a proven no-fault reason, illness or a genuine emergency, you'll still receive a flat 30% of the agreed price, in recognition of the work and materials already committed.
15. If Something Doesn't Match What You Described
We only step in if a delivered piece is objectively different from what you told the collector, a materially different size or technique, or a piece that doesn't resemble the portfolio you shared, never because the collector simply didn't personally love the outcome. That's part of the surprise they signed up for. If it does happen, you keep the original payment, but we'll ask you to create one corrected piece in line with what you originally described. Where a case isn't clear-cut, Soul Portrait makes the final call.
16. Copyright & Intellectual Property
The collector owns the physical piece once delivered: they're free to keep it, display it, photograph it for personal use, and resell it. You keep the copyright. The right to reproduce or sell copies of the work stays with you by default, though we ask that you don't reproduce or sell a copy of that exact piece to anyone else, it was made for one person. You're welcome to include the piece in your own portfolio, publicly or privately, as long as you credit it as a commissioned work made for Soul Portrait.
If you capture “making of” material, that's yours too. We ask for a license to include it with the delivery package, and separately, your permission before we ever use it (or the piece itself) in our own marketing, we won't do that without asking first. Neither we nor anyone else may use images of your work to train an AI model without your explicit consent. Nothing here overrides your right to be credited as the piece's creator.
17. Working Directly With Collectors We Introduce You To
Anonymity is one of the things we promise collectors, so we ask that any commission with someone we've introduced you to goes through Soul Portrait, not around us, for five years from that introduction. This applies whether they reach out to you or you to them, replying to a message isn't a problem, completing a paid commission outside the platform is. Breaching this is grounds for removal from the platform.
18. Confidentiality
Any personal information about a collector that reaches you incidentally (through a relayed question, for instance) is theirs, not yours to keep, share, or reuse beyond that specific commission.
19. Termination
We can end our working relationship with you at any time, and you're free to stop accepting new commissions from us whenever you like, commissions already underway are unaffected. Breach of this agreement, including §17, is grounds for removal from the platform.
20. Limitation of Liability
Our liability in connection with any commission is limited to the amount you were due to be paid for that commission. We're not liable for indirect or consequential damages.
21. Governing Law
This agreement is governed by the laws of Ireland, consistent with our collector-facing terms.
22. Changes to This Agreement
We may update this agreement from time to time. We'll let you know when we do. Continuing to accept commissions afterward means you accept the changes.
